Terms of Service
Effective [EFFECTIVE DATE] · Last updated [EFFECTIVE DATE]
Agreement
These terms govern use of Omtala, operated by [LEGAL ENTITY NAME] (“Omtala”, “we”). By creating an account or using the service, you agree to these terms on behalf of yourself and, if applicable, the organisation you represent.
The service
Omtala tracks how AI platforms respond to questions you configure, and reports on your brand’s visibility, citation sources, and sentiment across those responses. You can create a free account to explore the product; using it beyond the free tier requires an active paid subscription.
Because Omtala’s core function depends on third-party AI platforms (currently Google/Gemini, Bing, Bing AI, and Perplexity) that we don’t control, we can’t guarantee continuous availability, completeness, or accuracy of tracking results on any given platform — those platforms can change their interfaces, rate-limit, or block automated access at any time, which may delay or interrupt results. We’ll do our best to keep tracking running reliably and to tell you if a platform becomes unavailable for an extended period.
Plans and billing
Omtala is offered on two paid plans, billed monthly in advance in GBP via Stripe:
- Starter — £149/month
- Agency — £399/month
Current plan features and limits are shown at checkout and on your billing page, and may be updated from time to time. Subscriptions renew automatically each billing period until cancelled. You can cancel anytime from your billing portal; cancellation takes effect at the end of the current billing period, and we don’t offer refunds for partial periods[, except where required by law]. We’ll give you reasonable notice of any price change before it applies to your next renewal.
Acceptable use
You agree not to: use Omtala to violate any law or third party’s rights; attempt to reverse-engineer, scrape, or interfere with the service or its infrastructure; share your account credentials outside your organisation; or use the service in a way that places excessive load on it outside normal use of your plan.
Your content
You retain ownership of the client, product, and question data you enter into Omtala. You grant us a licence to process it solely to provide the service to you. You’re responsible for having the right to share any information about your own clients that you input.
Our content
The Omtala software, branding, and website — excluding your own content — are owned by us or our licensors. Nothing in these terms transfers that ownership to you.
Termination
You may stop using Omtala and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these terms (including non-payment) and don’t remedy it within a reasonable period after notice.
Disclaimers and liability
Omtala is provided “as is”. AI-platform responses reflect what those third-party systems returned at the time of tracking, not a guarantee of accuracy, and shouldn’t be treated as the sole basis for business decisions. To the extent permitted by law, our total liability for any claim arising from your use of Omtala is limited to the fees you paid us in the 12 months before the claim arose, and we’re not liable for indirect or consequential losses.
Governing law
These terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of its courts[, unless local consumer-protection law says otherwise].
Changes to these terms
We may update these terms from time to time; material changes will be notified to account holders directly, and continued use after they take effect means you accept them.
